There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.
On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

Everybody please post the names of attorneys who are easy / not easy, safe / not safe to deal with. People can post the names of the attorneys and a brief description (without specifics) about the problems / happy endings, they encountered. This could become an excellent review post for immigration lawyers. we could also maybe put 3 or 4 criteria to score them from 1 to 4. for eg:-
availability to answer questions
timely filing
acurate filing (with all documents)
current with legal provisions and latest changes
overall easiness to work with

etc etc

Hi,
I am really confused about my current status.
I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.
I got my petition approved, but my change of status was denied.
The reason was stated as :
The status previously accorded the worker had expired before this petition was filed. Therefore, the worker si not eligible for change of status.
Now, I am still in US. Is my status illegal?
Unless there is more to the story, you are currently in F1 status assuming that you are not violating OPT rules (e.g., you must be employed in your major field of study --- you cannot keep looking for job on OPT more than 3 months or so, IIRC). Your F1 status will cease when the OPT expires. You will go out of status from June 1, 2010 and so you should go out of US on or before that date. Then you need to get H1-B visa stamp from a consulate abroad (usually it has to be the consulate in your home country for the first stamping) and reenter US.
Make sure that you are not violating any OPT rules --- maybe USCIS thought that you are and that is why they denied COS?

I have a quick question about PERM requirements. I was told by my attorney that if I own my company�s stocks, I will be considered a part owner of the company and this will automatically trigger an audit.

Hi Guys,
I was reading another thread and a question came to my mind..
I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.
Can anyone can shed some light on this situation?
If your AP expires, renew it. Dont worry about I-94

The Council of Graduate Schools (CGS) issued an August 20, 2009 press release, reporting a decline in offers of admission from U.S. graduate schools to prospective foreign students. This is the first decline in the rate of offers to foreign students since 2004.
While these significant reductions affected the overall decline in foreign student enrollment, the number of offers of admission to students from the People's Republic of China grew at a rate of 13 percent. The CGS press release indicates that this was the fourth year in a row of double-digit growth in the number of students from China offered admission to U.S. graduate schools.
With the up coming biggest education Expo in China (http://www.phdchina.org/english/index.shtml), the US is the country of Honour at this show. This is a clear sign that Chinese students are looking at the US as the main destination for studies and future opportunities.
There is a significant economic contribution made by foreign students in tuition and related expenditures, as well. Generally, a foreign student is required to pay tuition at the much higher out-of-state rate, even when attending a state school. The potential of Chinese students boosting the economy is significant and should not be ignored. Even Consular officers realize this factor and student visa (http://www.h1b.biz/lawyer-attorney-1137176.html) issuance to Chinese students has increased by 40% according to a recent survey.

Even I am very worried about the same as my filling for H1 extn is going to come soon and due to the recent denials, I am very worried. I don't have EAD also with me and my priority date is very late. I heard about 3 cases where H1 extn is denied.

I don't recall the exact settings off hand, but the lense is a cheap canon
75-300mm I picked up for $200 bucks. I believe it was shot at F5.6@ 300mm

My I-140 case status has been changed today to
"This case has been received from the State Department with a request we review it."
My I-140 was already approved a year back and my I-485 is pending.
My I-140 was applied based on my own labor not labor sub.
Does anybody have clue about this?
My H-1B 3 year extension (based on approved I-140) is pending with USCIS. Do this has to do anything with this?

Hi, I am currently on my 5th year H-1B visa. I have an option to stay with the same firm and they will help me apply greencard. But I am also considering an opportunity in Bermuda for a 2-3 year program (with the same firm).
My question is if I come back to the US after 2 years, will I be able to apply H-1B visa again? Will it be a whole new H-1B petition/application process subject to the H-1B cap?
Or will it be just another H-1B renewal process following my previous two terms?
Do I need to wait for another two terms of H-1B to expire before starting the greencard process?
Can I ask my currently employer to apply for greencard concurrently while I am working outside the US?

I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.

If I don't use a compliant marriage broker to meet my fiance, then my K1 visa gets denied, automatically, because I met via a "black market" broker, for lack of a better term.
Is that true, or is he just trying to scare me into using HIS service? I've read the ENTIRE text of the International Marriage Broker Regulation Act (it's not a very big statute to read; it's a subsection of a much larger act), and it never says anything about how I should get denied to sponsor my fiance's visa because my BROKER didn't conduct the background checks.
I wouldn't be this concerned if it weren't for the fact that there are very few sites that seem to comply with IMBRA's criminal background check regulations. I have no problem telling the woman that I'm not a criminal (I've got nothing to hide), but why should I be denied the right to marry her, forever and ever, with no recourse, since the damage has already been done, because my BROKER messed up?

Approved labor (PD 2003 EB2) from company A (not employed with them). Filed 140 and 485 (self as primary and wife as dependent). Ability to pay RFE on 140 and then denial on 140 and 485. Currently, appealed the decision because needed to get H1 extension and case has reopened. My wife (with company B) had her 140 approved (EB3 with PD 2006) and so after the July bulletin filed for 485 (her as primary and me as dependent) because my case seeemed a little dicy.
So we both have multiple 485's filed (although the first one since the decision is not final on 140 technically they might not have started considering the 485). Read multiple places that legally you can have only one 485 approved but could have multiple 485 pending and withdraw the other once anyone has been approved. Is this true? or you CANNOT even have two 485 pending?What is the best thing for me do do right now?
