2)If we don't want to choose a new attorney, but want all the communictation(such as RFE to come to you), What is the process ?
I read somewhere that you can do this by filing a new G-28, but not sure of the step by step process and the documentation needed.
Appreciate as much details as possible from someone who did this.

1. Fill new G28 and singed by the applicant and the new attorney and send it to USCIS
2. Fiell new G28 form or send a letter to USCIS, saying that the current atttonreny on the file does not represent you any more and to send any future correspodence to the specified address. I think there is a separate P.O addresss you have to send this letter. Check the USCIS site

Funny birthday card withI am already working on EAD. I have got an employment offer from a big fortune 500 firm as a lead technical analyst. The offer is too good to miss. I am trying to understand in my job will be "same or similar" while my job responsibility was "programmer analyst" in labor certificate and i would get a job as lead architect. Following are some more details about may labor doc.
a) Though my job title is like programmer analyst, my SOC job code is given as 17-2071.00 which is "Electrical Engineer"
I was never an electrical engineer (not even by my education). I do not know why the original filer used such a SOC code. Now my new role (lead technical architect) will have a SOC code as 15-1031 as that is for computer architect.
Morever my new employer will not provide me a Ac21 portability matching my labor cert.
My role responsibility is following as per labor cert.
Job Title: Programmer/ Analyst/Systems, Software/Engineer/Developer, or Related to IT
Reponsibility:
develop, create and modify general computer application software. Analysis user needs and design, develop software solutions. Design, develop, analyse and implement software and end user product. Coordinate various account projects with IT consultants; nurture close relationship with the major account customers by providing quality technical support and apply principles of computer science, engineering and mathematical analysis.
Do you feel that changing the job as lead architect willl be a paradigm shift for me causing my GC gone denied?

My employer applied for my PERM and i-140 in 2005 in the EB-2 category. Both were approved.
In 2007, I left my employer to pursue an MBA, and converted my H-1B to F-1 visa. Now I am planning to return to my old employer.
I would like to know whether
a) if my employer did not revoke my i-140, is my old PERM still vaild? Can I apply for a new I-140 and a new I-485 using my old approved PERM.
b) if my employer did revoke my i-140, is my old PERM still vaid? I know I can retain the priority date, but was wondering what is the status of my old PERM?
Any help is appreciated.
I know that PERM is valid only for 180 days, and an i-140 has to be filed within that time, which was done in my case. However, does the law say anything about PERM validity if the i-140 is revoked?

Does anybody here got a rejection becuase of the incorrect filling fee?
If so can you share the message on the lette which was received along with the rejected application.
I have received a rejection letter for my spouse with the following message in it.
"The above application or petition, along with any check or other form of fee payment, is attached. The application or petition cannot be accepted because the proper fee of $1010.00 U.S is not attached. Since the case is not properly filed, a priority or processing date cannot be assigned.
Please attach a check or money order for this amount and resubmit this entire package to the address listed below. To speed processing, please leave this notice on top."
Can anyone confirm with me if they got the same message for incorrect filing fee? The message is very ambigious if the filling was incorrect or they did not find the filing fee attached with the application.
Please reply to this posting with the message they received for rejection of their application or if anybody has any information on this.

I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks
You have to wait until Oct 1st.When SSA checks against USCIS database to check your status, they will know that the Change of status occurs on Oct 1st .
In my wife's case we had to go almost everyday during the first week of October as they couldnt validate the H1 status and then finally they did on the 6th day.
FYI she changed from F2-H1

They Sent me This Email:
Your I-485 received on 5/21/07 and the Southern Service Center(TSC) is working these types of applications filed 9/11/06. They received your biometrics from the ASC 6/13/07 and the case has been assigned to an Adjudicating Officer for review. But, by the processing times, you still has a little time to wait.
Couple of question: They received your biometrics from the ASC 6/13/07 : Is this mean my FBI and Name Check cleared : I did my FP on same day?

Thanks for ur answer. I saw case posted by Loti_GC and his did not seem to be the case of two different I-140. That what got me concerned. When I called USCIS they declined to reveal this information,
EB2, if your I-140 approval reads as "Section: Mem of Profession w/Adv Deg, or of Exceptn'l Ability Sec.203(b) (2)" You should be worried only if you had two different 140 with the same employer. Take infopass and give a try, there is no standard procedure to find out.
I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.
