I�m working for company A and company B has sponsored my GC as future employee and also did a H1 transfer from A but got a big RFE. Now company C is ready to do H1 transfer. Is it a good idea to do so or would get into problems as GC is in process through B? We did I-140 & I-485 concurrent filing and got our EAD�s approved but I-140 is still in pending status. I heard that using EAD is not a good idea when I-140 is pending.
My Attorney is sending a response to RFE but I�m not sure whether it gets approved or not. What happens if B transfer gets approved and would choose to work with B and not use C at all (if it gets approved)?
In the other way, If C gets approved and choose to work with them as the H1 with A expires pretty soon (got to move out) can I comeback to B with a fresh (another) H1 transfer. Please suggest what is the best to do at this time?

Since Company A has not canceled your H1, you can join them anytime.
No need to re-transfer.

The Department of State has published a pamphlet educating nonimmigrant visa holders on their rights. The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. Last week i received the letter about my RFE for my I140 which they received on Feb 8, 2007. I'm a EB3 category from Bangladesh.

Is there anything else extra i have the provide. do i have to worry about anything towards my approval or this is just a regular process to go through.

We are in the same situation, filed 485 on July 8th at NSC & EAD/AP on August 12th using 485 proof of delivery. Received receipt notices, FP done, 485 transferred to TSC, but haven't received EAD/AP. Planning to take Infopass appointment.

i am in a similar situation. i consulted a lawyer who said that even 1 day spent out the country can & must be taken in to account (for the 365 day eligibility). as long as your PERM LC was filed, you should not have a problem.

When checked on the USCIS site it shows the following for a reciept no which was sent by the attorney. The attorney seems to have e-filed a bunch of applications. Does the e-file reciept no sent belong to one person or a group of people filed by the attorny. If it for a group of people, how do you know if a particular persons application is in the bunch that is being recieved.

Hi,
I have an approved LC, I140 and I485 pending with EB3 PD DEC 04 supported by my employer. My employer recently filed an LC perm for another employee for the same position as mine under EB2. Can my employer use the same recruiting documentation used for this perm to file new perm for me under EB2 since both positions are w/ same title & description & same employer. Can someone answer this please.

Once the consular services for immigrant and non-immigrant visas begin operating again, we can only imagine the huge backlogs that will exist for visa applicants. According to consular officials and a U.S. Citizenship and Immigration Services (USCIS) local office at a State Bar of Texas meeting, the U.S. Consulate in Ciudad Juarez is the largest in the world. There are numerous processings of visas taking place at Ciudad Juarez per day. The consulate processes between 800-1200 immigrant visas each day, 1,000 non-immigrant visas each day, 70-150 waivers each day, and 50-100 various other services for U.S. citizens.
Once the consulate begins its daily operations, applicants should arrive 15 minutes prior to their appointments. There is a parking lot across the street from the consulate, in the Centro Commercial. Before walking to the consulate, it is important that applicants leave their cell phones and any other electronic devices in their cars. After checking that all electronic devices and other prohibited items are left in the car, the applicants will enter the building and go through security. After going through security, they will be issued numbered tickets. All U.S. citizens should be prepared to present their passports (or passport cards if traveling by land) beginning June 1, 2009. After their interviews, a courier service, DHL, will deliver their visas within 2-3 days.

Refer processing times at https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC and search for "All other applicants for advance parole". Right now they are processing July 03, 2007 cases.
