In general, I see a lot of members quoting stuff that indicates shortage of tech workers and saying we should use them.
While this is true, it is worth understanding/appreciating the fact that most of these articles are aimed towards increasing H1 quota and not necessarily improving EB retrogression.
We should be a little careful which articles we use.

Hi ,
I received NOID on my i 485 (to be precise here is what it states)
1)" 140 filled on behalf of you has been revoked by my previous employer ,also mentioned as it is after 180 days of filling my 485 ,but my application still valid with in the meaning of section 204 of the act.
but they asked for employment verification letter from my recent employer with duties,educational qualification and offered wage of salary as it is .
2) Inmatter of semerjian ,it was held that an immigrant alien with in the purview of section 212 (a)(14) must establish a bona fied intent to work in USA,immediately or in fore seeable future,in his or her qualifying endeavour or in a related field.
3) It was further held in matter of tanaham ,18 I & N dec.339(reg.comm.1981)under section 245 of act who meets the objective pre requisites is merely eligible to apply for adjustment of status. when an alien seeks the favourable exercise of discretion by this service ,it is incumbent up on alien to establish that he or she merits adjustment
what does number 2 and 3 mean? what should be provided in evidence to that?Please advice.
The date on the notice is june 23 rd ,but i received my mail 2 weeks back to the adress where i work.(say july 24 th)

Responded to my RFE with EVL (emploment verification)way back in august 2008 through attorney .so considering the date on notice that is june 23 rd. 33 days time has passed.but when i consider the date i received i still have time,which date should i consider,iam confused....,is it OK if i send my reply next week.Now iam worried,as just now i came to know about my letter from uscis(no online update though). what to do now,iam worried ,please advice.

No it is not but the chances of getting a stamp is higher or at least it use to me.
I remember going through the same thing few years back but then economy was not as bad it is today. Always remember the guy's job at US Embassies is to stop people from coming or act like a gate keeper.
Just carry all your supporting documents like:
Tax returns
Offer letter
Letter from the company stating your continuous employment
Pay stubs
Bank statemen
ts and any assets you might have in the US (property, etc.)
Good luck

I am not an immigration expert, but don't you need to show spouse's valid H1 visa to get a H4 visa? ... Unless both spouses are applying for their respective visas at the same time.

These guys did not mention specifically "legal immigrants" but to me that sounds even easier since most of them possibly have decent wages and also maintain a legally sound lifestyle.

I hear that any transfer of a visa to a different one, in your case from L1 to H1 need to go back to your home country for stamping. Please consult an immigration laywer for more details.

That I intend /do not intend to make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish
room and board, state for how long and, if money, state the amount in United States dollars and state whether it is to be
given in a lump sum, weekly or monthly, or for how long.)
if I check 'I intend', what explanation I have to write for this. Please advice...

I am on H1b and work for a desi consultancy company. My project with a client ended some time ago and due to bad market, I have been so far, unable to get onto another project. Now my employer is asking me to go back to my country for some time as I dont have a project in hand. I am worried that this may result in canceling of my H1b visa. However, employer is trying to assure me that he won't cancel it. I am wondering has anybody (somebody you know) been in this kind of situation. FWIW, I do have an american undergrad degree and have been living here legally and lawfully for past nine years.

Guys,
Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?
She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.
We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?
A lot of you may have experienced the same dilemma, so please let me know...
