As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)
Yes you can, start your company and volunteer for the company but not together :(
You can start your own company but can not work in it.
You can take a part time/ 2nd job by filing a 2nd H1 (the 2nd H1 will be in addition to your first H1), but you can't own that company!
Interestingly your wife can start a company and sponsor your 2nd H1 in her company ;)

I had applied for my I-140 to seek an extension from Oct-09 to OCT-10..Instead I recieved an I-140 with expiry date of Oct-09 itself..what to do now..I know its a genuine mistake..but not sure how to get that addressed..:confused:

Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?
Generally you should get 3 years, if you have three years to get to the 6 year limit of H1B.
Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp
A Colleague of mine did this and did not have an issue. He went to india last Oct with his previous visa stamped in his passoort and I 797 approval of the new visa. My Company lawyers told him that he wont have any issues and he is back from his vacation and working. So i guess he did not have any issues.
What I dont know if how long was his previous visa valid for but I dont think it should matter till it is valid for sometime when you try to enter the country.

Here is my situation I am a green card holder since 1996. However I waited until now because I had I received probation before judgment in 2003. The case was expunged in 2007. The conviction was Annotated Code of Maryland article 27 , section 146 (c )(1 ) stipulating that : Any person who violates any provision of subsection (c)(1) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 3 years or both.
According to the information I found on USCIS, you can not have any conviction in the five years preceding your application; It looks like I should be fine. I am ready to apply now and it has been a good obedient green card holder for 6 years now, I don't have any issue with the law since 2003.
I am also married to a US citizen and have three children (all citizens). I was able to get all my information from the court prior to the expungement as well.
Please let me know what you think. Thanks you so much.

Hi,
I am working in company 'A' on H1B, Green card is processing from company 'B' as future employee. Got EAD.
The job is getting over from Company 'A'.
Can I use my EAD and can stay in US with out working to any company?
Will there be any issues if TAX is not paid when I am not working.
If i work part time then on do I need to work for company 'B' only?

My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).
1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?
What type of documents, forms are involved ?

Hello everyone
My GC is during I-140 step as EB2 category with A company.
Currently, My company A is working on reorgnization. I am not clear which term I can use to descrip this changes:
Please reviwe the steps below:
1. currently company A will setup a wholly subdivison as B (LLC);
2. Company A will contribute its buiness and all assets to B for exchange 100% member shares before closing dates;
3. Investor C purchase 55% member shares of B on the date of closing this deal.
A company will be remain exit after closing, but it is only tax shell for the owner, it will be prohibit to do any similar business in the future, B get A's original buiess and all assets.
If anyone have similar situation before, and can give me some advisor on how to file the docuementation to show B is"Successor in interest" of A after closing deal.

Yours will be EB1C. You can expect to get GC in 1-2 years.
If i-140 premium processing comes back, then typically within an year. (know of 2 people who got done within 8 months... EB1-India). Right now the I-140 is going to take the longest time..

You can get quite far using just Blend, but you probably want to use Visual Studio for the coding and debugging features that Blend doesn't have.

I think if the I140 is cancelled you can't port the priority date unless. If you would have applied for I485 than that is different case.

No, not necessarily in my opinion. She has legal F1 status and that is what you will show on the relevant forms.
I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
Will appreciate if anyone has had similar experience and is willing to share.

Hi,
I am on H1b visa and it is expiring in sep 2009 in 2 months. I need some information incase i dont get a project in mean time. I already got RFE for the extension.
Is it better to convert to H4 visa? How much it costs? and how long it takes to convert? Also do we get any kinds of problems in converting to h4 visa?
Also if we converted to h4 visa, can we easily get f1 visa if we want to study later or can we go back to h1b from h4 visa.? what all things are required.
Please let me know.

Your question is not clear. H1 is a work visa, H4 is for dependants of H1. F1 is family visa. There are no conversions. You get whichever is applicable to your situation.

Employment Letter is a part of the initial evidence. There is a memo recently saying that any missing initial evidence will result in denial of application without RFE. Try to cajole your employer and gather as much evidence as you can about being asked for $$$ for helping you file 485

I'm a mechanical engineering and also have an MBA degree.
I work as a support engineer.
My lawyers tell me that I cannot apply in EB2, since my Post grad degree is unrelated to my grad degree and so does not apply to my job.

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.
That will cause the PERM to expire without filing I140 since PERM expires in Dec. Is there anyway for us to file extension for the PERM ? More than 180 days...
I think they should still be able to file your I-140 in regular processing by not including the latest tax papers (include previous years). Since it takes a few months to process I-140 under regular filing, they will likely issue an RFE asking for tax documents. Hopefully, by then they are done with their audit and would be able to reply to the RFE with tax documents or provide explanation on why they cannot provide the requested documents but they can provide any other document that proves their ability to pay. That way, you won't lose your approved PERM.
